Brydon Carse has been charged by the Cricket Regulator over an incident outside a Derby nightclub but remains available for selection by England.
Carse was arrested and then de-arrested in the early hours of 23 August. A subsequent investigation into allegations of an assault was closed by Derbyshire Police with no action taken against the 31-year-old.
On Friday, the Regulator confirmed the pace bowler has been charged with breaching the England and Wales Cricket Board's (ECB) professional conduct regulations.
"The matter will now be referred to the independent Cricket Discipline Panel for adjudication," said the Regulator. "As the process is ongoing, no further comment will be made."
Carse is alleged to have breached regulation 3.2, which states: "No participant may conduct themself in a manner, do any act or make any omission at any time which is improper or which may be prejudicial to the interests of cricket or which may bring the ECB, the game of cricket or any cricketer or group of cricketers into disrepute."
In the aftermath of the Derby controversy, Carse was dropped from the England squad to play Pakistan in the second Test at Lord's and has not been called up since. He has continued to play county cricket for Durham.
